TERMS & CONDITIONS POLICY
1 TERMS
(a) This policy governs your use of the Cycology Club Website (“the Website”), Cycology Club Social Media (“Social Media”), the Cycology Club Mobile Application (“the App”) and all Cycology Club studios. The Website, the App and our Social Media platforms are designed to allow clients to make purchases, register for classes, reserve bikes and communicate with the Cycology Club team (“Cycology Club”).
2 PRIVACY, PERSONAL DATA & COMMUNICATIONS
(a) If you use the Website or the App, you are responsible for maintaining the confidentiality of your account, password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account and password.
(b) When you visit the Website, use the App, or communicate with the Cycology Club via email, you consent to receive ongoing communications from Cycology Club managed under the guidelines of the Australian Communications Media Authority. Cycology Club will communicate with you by email or by posting notifications on the Website, App and Social Media platforms. If you do not wish to continue to receive ongoing communications from Cycology Club, you may do so by using the relevant unsubscribe facility available.
(c) By accepting these Terms and Conditions you understand and agree that all agreements, notices, disclosures, and other communications that Cycology Club provides electronically, satisfy any legal requirement that such communications be in writing.
3 USER PROVIDED INFORMATION
(a) Except as provided in subclause 3(e), Cycology Club does not collect any personal information about individuals, except when such information is knowingly provided to Cycology Club. Personal information might be obtained from online transactions such as class/series purchases, retail purchases, and/or class registrations.
(b) Personal information may also be transmitted as part of a form submission or in connection with other activities or services made available on the Website or App or by data generated through Social Media.
(c) Any personal identification information collected by Cycology Club is voluntarily provided by the user. You may review your personal information through your Cycology Club profile.
(d) Cycology Club may use the information provided by you to contact you with important information, required notices, and marketing promotions from our partners and collaborators.
(e) In circumstances of there being a claim by you against Cycology Club for any injury sustained during a class, you agree that Cycology Club may provide information to a third party upon request.
4 SECURITY STATEMENT
(a) Cycology Club makes every effort to ensure that all of the transactions that occur on the Website and App are secure. All credit card numbers and transactions are encrypted using Mind Body Online.
(b) Cycology Club will provide physical, electronic and procedural safeguards to protect information we process and maintain and have policies in place to protect from cyber fraud.
5 COOKIES
(a) Cycology Club may use cookies to control access to certain features such as your password and account, to customise content areas, or to analyse site activity and user behaviour. Cycology Club reserves the right to use cookies in the future in conjunction with new content or expanded functionality.
(b) If you are concerned about the use of cookies, you can explore your web browser’s options to notify you whenever a cookie is set, or to disallow cookies altogether. You should be aware that prohibiting the use of cookies will significantly restrict access to certain types of content or features.
6 HOW INFORMATION IS USED
(a) The following are examples of how Cycology Club might use personal information:
i. If you purchase a Cycology Club series, sign up for a Cycology Club class, or purchase in-studio retail products, the required personal information will be used to complete your order.
ii. If you indicate that you are interested in receiving Cycology Club related news and information, you may receive emails to the email address you provided as part of the registration process or, through push notifications and text messages to your mobile device.
(b) For the non-personally identifiable information collected by the Website or App, Cycology Club will never share contact details or any personal data with third parties.
(c) Cycology Club reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.
7 MINORS
(a) If you are under the age of sixteen (16), you may register and use the Website and App only with the written permission of a parent or guardian.
(b) Cycology Club does not accept the online registration of minors (aged 12-15 years). Registration of a minor must be completed by a parent or guardian in person at one of our studios. Minors who meet the minimum height requirement of 150cm and who have submitted a Waiver Form that has been completed and signed by a parent or guardian, may then be permitted to sign up for classes through the Website or the App.
